Vacation Rental Terms & Conditions

Agency Disclosure:  Pismo Coast Management & Realty Inc., herein after referred to as PCM serves as agent for the owner, and Vacation Renter agrees as follows:

1.      Rental:   Vacation Renter acknowledges, understands and agrees to the duration and fees detailed in the reservation confirmation as selected by the Vacation Renter.  

2.      Reservation Hold Deposit:   A $529 reservation hold deposit is due at time of booking to confirm reservation. If reservation hold deposit is paid by check it must be received within 7 (seven) days of booking.

3.      Security Deposit:   The Vacation Renter may choose a Security Deposit Protection option or a Refundable Security Deposit option.  Note:  If booking on-line the Security Deposit Protection option will be selected automatically.  Vacation Renter must contact PCM to change to the Refundable Security Deposit option.

a.       Security Deposit Protection:

·        Security deposit insurance is purchased through CSA for $29 per reservation.

·        This Security Deposit Protection plan covers unintentional damages to the rental unit interior that occur during your stay, provided they are disclosed to management prior to check-out.  The policy will pay a maximum benefit of $3000. 

·        Any damages that exceed $3000, unreported damages, or damages not covered under the CSA Security Deposit Plan will be billed to Vacation Renter or charged to the credit card on file.

·        If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3000.  Certain terms and conditions apply- see CSA Security Deposit Plan.

·        Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy.  The Security Deposit Protection can be purchased up to, and including at, check-in.

·        By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly PCM any amount payable under the terms and conditions of the Security Deposit Protection.  Please contact PCM directly if you do not wish to participate in this plan or assignment .

b.      Refundable Security Deposit:

·        A $500 refundable security deposit is required.

·        If no additional charges are incurred the $500 deposit will be refunded within 21 (twenty-one) days from departure date. 

·        This security deposit is refundable provided there are no damages caused by the Vacation Renter or Vacation Renters guests.  In the event damages are discovered upon Vacation Renter departure the security deposit will be used to cover these charges.

·        Any damages that exceed $500 will be billed to Vacation Renter or charged to the credit card on file.

Unauthorized and/or misuse of property includes but is not limited to the following:

·        Excessive utility usage, excessive spa/hot tub maintenance, smoking, pets, purchasing movies, events, etc. through cable/satellite, chargeable phone calls or features, moving furniture, broken, damaged or missing furniture/property, carpet stains and any defacing of property.

·        Linens and towels (except for beach towels) are provided for Vacation Renter and are not to be removed from the unit at any time.  If removed replacement cost will be applied.

4.      Payments:   Balance of reservation must be paid in full 30 (thirty) days in advance of check-in date.  If Vacation Renter has not contacted the office to make other arrangements we will automatically charge the balance due to the card on file.  If reservation is placed within 30 days of check-in date PCM will require payment in full at time of booking.

5.      Travel Insurance:  We highly recommend that Vacation Renter select the optional Travel Insurance provided by CSA which provides benefits for cancelled or interrupted trips as well as for covered unforeseen incidents while on your trip.  For more information see the CSA Travel Protection policy.

6.       Cancellation Policy:

·        If cancelled 30 or more days prior to arrival date; loss of $100, loss of processing fee, and loss of costs associated with the purchase of Travel Insurance.

·        If cancelled 15-30 or more days prior to arrival date; loss of $500 reservation hold deposit, loss of processing fee, and loss of costs associated with the purchase of Travel Insurance.

·        If cancelled less than 15 days prior to arrival date; loss of rent, loss of $500 reservation hold deposit, loss of processing fee, and loss of costs associated with the purchase of Travel Insurance.

There are NO EXCEPTIONS to the cancellation policy

7.      Cleaning Fee:   Cleaning fee is non-refundable and will not cover excessive cleaning or damage. Cleaning fee is a non-negotiable mandatory fee.

8.      Pets:   No animals will be kept on or about the premises without prior written approval.  Violation of this rule will result in automatic forfeiture of Vacation Renters entire $500 security deposit (if Refundable Security Deposit option chosen) or $500 will be billed to the Vacation Renter or charged to the Vacation Renters credit card on file (if Security Deposit Protection option chosen).  Additionally, Vacation Renter will be required to remove the pet from the premises immediately.  Service dogs may be allowed upon request, verification, and written approval from PCM.

9.      Smoking:   Is not allowed inside the property and any costs to remove odor or repair damage will be the liability of the Vacation Renter.

10.  Occupants:   The Vacation Renter on record must be an adult of legal age and an occupant of the unit during the entire rental period.    Each unit has a maximum occupancy as indicated when reservation is booked and must not be exceeded.  These limits are required by law and are for the safety and protection of occupants and owners.  Abuse of unit capacity could result in additional charges or immediate eviction and forfeiture of rent and/or deposit funds. 

11.  BBQ Use :   Properties with propane grills are fueled by liquid propane and under NO circumstances may guests add any other fuel (charcoal, wood, paper, etc.) to propane grills.  If propane grills are fueled by anything other than liquid propane Vacation Renter will be charged for all costs incurred to clean/repair grill.

12.  Fireplace Use :   Fires cannot be left unattended.  Properties with gas log fireplaces are fueled by gas and under NO circumstances may Vacation Renters add any other fuel (wood, paper, trash, accelerants, etc.) to gas fireplaces.  Properties with wood burning fireplaces or fire pits must only be fuelled by hardwood logs or presto logs.  Hardwood or presto logs are not supplied.  Vacation Renter agrees to pay cleaning or repair fees for misuse.

13.  Spa/Hot Tub Use :   Some properties have spa and/or hot tub.  All spas or hot tubs have been cleaned and properly maintained prior to guests’ arrival.  Vacation Renter should notify PCM of any issues and may be charged for any excessive cleaning and/or maintenance incurred during stay.  Spa/Hot tub use is at your own risk and PCM assumes no responsibility.    

14.  Alcohol/Drugs:   No drinking of alcoholic beverages by persons under the legal age of 21 (twenty-one) is allowed on rental properties.  Illegal drug use is strictly prohibited and will be prosecuted to the fullest extent of the law.  Violation will result in eviction and loss of reservation charges, including deposit.

15.  Use:   Vacation Renter shall not disturb, annoy, endanger or interfere with the right to quiet enjoyment of any neighbors or occupants of surrounding premises.  Vacation Renter shall abide by any by-laws or CC&R’s that may be applicable to the premises and further shall not use the premises for any unlawful purpose nor violate any law, ordinance or regulation.  Parties and gatherings must be approved through PCM or Vacation Renter/Vacation Renter guests could be subject to loss of deposit and/or eviction.  $40 per incident will be charged for disturbance calls made during the Vacation Renters stay.

16.  Maintenance:   Vacation Renter agrees to use, operate and safeguard the property and immediately notify PCM of any problem, malfunction or damage excluding normal wear and tear.  All repairs and replacements caused by Vacation Renter and Vacation Renter guests will be subject to applicable costs and service call charges. 

17.  Damages to Property :  Premises are to be left in undamaged condition.  All properties have been cleaned and inspected prior to Vacation Renters arrival.  Vacation Renter must call PCM if any damages are discovered upon arrival.  Failure to report damages may impact deposit refund. 

18.  Keys : Keys must be returned on day of departure.  Failure to return both sets of keys will require re-key of property.  If keys are lost Vacation Renter will be responsible for all costs incurred to replace keys and re-key property.  Assisted entrance due to lock-out after normal business hours will incur a $25 charge.

19.  Innkeeper Law:   Property is rented with all Innkeeper laws applicable not withstanding that daily maid service, central telephone, safe deposit boxes, food service and room service are not available. (Civil Code Section 1940)

20.  Entry:   Upon not less than 24 hours notice, Vacation Renter shall make the unit available during normal business hours to Agent or Owner for the purpose of entering to make necessary repairs or supply services.  In an emergency the Agent or Owner may enter the premises, at any time, without prior permission from Vacation Renter (Civil Code Section 1954).

21.  Holding-Over Penalty Clause:   Check-In time is 3:00p.m. Check-out time is 11:00a.m.  It is common that there will be another Vacation Renter who has reserved the same property after Vacation Renters departure. Vacation Renter must contact PCM prior to date of departure with any request and PCM will attempt to arrange for additional time if the property is available.  In the event Vacation Renter is not completely out of the property at 11:00am on the termination date Vacation Renter will be liable for the penalty of twice (2 times) the daily rental rate.

22.  Property Information:   Information on properties is maintained regularly but cannot be guaranteed. Rates, furnishings, fees and taxes are subject to change without notice. Please call or e-mail to confirm information prior to booking.

23.  Vacation Renter’s Remedies:   PCM is not liable if property is removed from the Vacation Rental program due to sale, lawsuit, death or similar circumstances.  PCM will offer comparable available properties managed at the same rental rate or refund all monies paid.  This is a Vacation Renter’s sole remedy.

24.  Personal Property:   PCM is not responsible for any items Vacation Renter or Vacation Renter’s guests leave in Vacation Rental.  PCM is authorized to charge a $25 handling fee and all applicable shipping fees if Vacation Renter requests items to be returned.

25.  Vacation Renter Liability:   Vacation Renter agrees to accept liability for any damages caused by Vacation Renter or Vacation Renters guests, other than normal wear and tear, to the property, including but not limited to misuse of appliances and/or equipment furnished.  If damages are in excess of the security deposit being held, Vacation Renter agrees to reimburse PCM for costs incurred to repair/replace damage or lost items.

26.  Release:   The undersigned for himself/herself, his/her heirs, assigns, executors, and administrator, fully releases and discharges Owner/Lessor from any and all claims, demands and causes of action by reason of any injury of whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of or in connection with the occupancy of the premises and agrees to hold Owner/Lessor free and harmless of any claim or suit arising therefore.

27.  Attorney Fees:   In any action or proceeding which concerns the rights, duties, or liabilities of the parties to this agreement, their principals, agents, successors, or assigns, the prevailing party shall be entitled to recover reasonable attorney fees and costs.

28.  Time:   Time is of the essence in the performance of this agreement.

29.  Sole Agreement:   This is the sole and only agreement between PCM and Vacation Renter.  Any and all changes must be in writing to be valid.
